The U.S. Court of Appeals for the D.C. Circuit granted NTEU’s request for en banc review of a 2-1 decision that had provided a path to dismantling the Consumer Financial Protection Bureau.
The U.S. District Court for the District of Columbia previously issued a preliminary injunction in May that stopped the Consumer Financial Protection Bureau from conducting reductions in force and other actions that would dismantle the Bureau’s ability to perform its work required by law. In August, a three-judge panel of the D.C. Circuit overturned this preliminary injunction, setting the stage for widescale reductions in force at the CFPB. However, because of NTEU’s request, the entire D.C. Circuit will now review the panel’s decision to overturn the preliminary injunction and may rule to reinstate the District Court’s preliminary injunction. If it does so, that will continue the mandate by Congress to protect consumers from predatory behavior by big lenders.
